General purchase terms and conditions for apps

I will try to keep this short but I feel it necessary to have something here in writing. These terms and conditions hold true for all app licence purchases from Canadian Gauges unless over-ruled by applicable laws in your/my jurisdiction.

  1. If your app does not perform as advertised or expected you may request a refund through PayPal or via email giving a valid reason within 30 calendar days of your order.
  2. Due to the nature of the apps sold running on Garmin hardware and software, certain performance aspects are outside of the control of Canadian Gauges. Therefore: a) Canadian Gauges will make a reasonable effort to maintain all apps sold in a functional state for at least three years following their release. Release date is found on Garmin’s App Store page. b) If a Garmin-related hardware or software change causes an app sold by Canadian Gauges to underperform, and a solution to such underperformance is not reasonably achievable, Canadian Gauges assumes no further responsibility to the purchaser. c) if the purchaser’s device becomes defective, Canadian Gauges apps may not perform as expected. In this case Canadian Gauges assumes no responsibility for performance issues. d) apps should only be used on a comparable device. See Garmin App Store if you have any questions.
  3. Standard Garmin terms of use cover safety and liability related items for these apps, and the overall use of Garmin fitness trackers/wearables but in brief, Canadian Gauges will not be held liable from any material or immaterial damages resulting from the downloading, running or use of any app sold. Canadian Gauges does not endorse the use of apps sold for any safety-critical application, nor should they be relied on to provide the user with any information in such situations. Apps should be considered for entertainment only.
  4. App source code and unique intellectual property within remain copyright of Canadian Gauges
  5. Purchases and any dispute resolution shall be governed by the laws of British Columbia, Canada.
